Only the 'Insane' ...would question the Smarts

I have only just come across the blog of Helene Davies-Greene and how she  had to go public to defend herself for stating the obvious , Madeleine Beth was not abducted and the slander she had to support because of her right to free speech.
It has now come to pass that a certain blogger who is 100% behind the McCanns involvement in this case, but not on another issue , which is also blatant fraud ,the 'Smarts'. It appears one must be insane not to believe Elizabeth but not insane to not believe the McCanns. I wonder if this blogger also believes the Ramsey story? Or is one insane to think the parents were involved in JonBenets death?

The only comments permitted on public forums in the States are from  Salt Lake City Mormons, which is why others have opened their own blogs to discuss this bizarre story , a 'story' that  does not add up and must be questioned.

The Ramsey and McCann cases,  now hold very little public interest. Both cases are only of interest to the accused (McCanns) of harming their children, their accomplices and those they pay to deny it . The Ramsey book written to slander the Police and show them as inept but most important to portray their innocence , looks like the template for the McCanns as Aunt Phill has already informed us.

The questioning of ones sanity because one chooses to question all three of these very bizarre tales, is an individuals right and a practicing Mormon has no right to tell others what they should or should not think even though their religion leaves them to believe they are ' superior' to the rest of us.

Madeleine Beth has not died in vain

She has been very important in showing the British people that innocence is betrayed everyday, by adults, children love and trust the most.

Robert and Jennifer Murat... and their very strange behaviour

Processos VI
1581 to 1584
Witness Statement of Maria Cecilia Pereira PiresDate: 2007.05.23

Profession: Journalist for Portugal Resident

She has been a journalist for about 16 years, but has worked for the above-referenced paper for about one month.

Questioned, responds that on the 4th of May, 2007, she was asked to go to Praia da Luz, Lagos, in order to cover the case of a missing child.

She clarifies that she was informed that the disappearance of the child occurred in the Mark Warner Ocean Club resort, and that the family/child’s family surname was McCann.

She responds that when she arrived at Praia da Luz around 09H30/10H00, and as she headed to the GNR post where she gathered some information, she then headed next to a group of journalists where she learnt further case details.

Because so little time had passed since the disappearance, she took the decision to walk around the area of the resort.

She adds that this decision was also made due to the information that the child may have left the apartment of her own accord, and may still be in the immediate area.

During her walk, she came across a bare patch of land, situated north, a few meters from the resort. She met a male individual, about 50 years in age, who approached her and asked if she was involved in the [read organized?] search for the missing child.

The deponent told him that she was not, even though she confirmed that she was looking, in order to calm her conscience a bit.

In this context, the individual proposed that both of them head towards a house, apparently unlived in, but not abandoned, with the intent of looking for the child, and so it would not appear like trespassing.

After entering the parking area of the residence, where they called out to see if anyone was home, they verified that a woman was inside. This was a woman of advanced age, around 70 years old, 1,5 to 1,6 metres in height, with grey hair combed and coiffed in the shape of a “banana”. The individual with the deponent asked this older woman to help them search for this child. This older woman agreed.

She clarifies that the individual headed toward the pool zone and the deponent, accompanied by the older woman, lagged behind as the older woman walked slowly.

During this time, the older woman exclaimed to the deponent that she was bothered with the entire situation of the disappearance and further commented that the parents had to be going through great anguish.
The above conversation occurred in English, with the older woman indicating that she lived about 100 metres from the resort, and that the night prior she noticed the arrival of the police due to their sirens. This was around 22H00.

The woman in question told her that she had been having dinner with her son when she heard the sirens, and assumes that it was at this time that the disappearance was noted.

She clarifies that the older woman did not speak about a ‘child or a boy child’ and specifically mentioned “a girl child”. The deponent did not find this strange because by that time, May 4th, everyone knew it was a girl child that had gone missing.

The woman above also indicated that her son was working with the police in trying to locate the child.
She adds that after searching the area around the residence where they found nothing, (the same can be said for the pool neat the house), they were stopped by a neighbor. From what she could make out, he was German but asked them in English what was going on, and then after responded that the Police had been searching the area with dogs.

During the conversation with the older woman, the deponent was introduced to this individual. The deponent confirmed that she was a journalist. The other individual told them that he was searching for the child. The deponent then left the area and the other individuals staying behind.

This situation appeared to her very normal.

She responds that during her work, she came to know the son of the older woman. The journalists referred to him as Robert Murat. He was someone who was involved with the journalists and police with much freedom. He spoke both English and Portuguese.

She states that on the 5th of May, the British journalists affirmed that Robert Murat was one of the suspects in the missing child case. He appeared very much surprised at this and confirmed that he was going to back-off so that he would not be the subject of such comments. Following this point, it was very difficult to contact him.

She clarifies that when she saw the pictures at the information kiosk operated by Robert’s mother, she was certain that his mother was the same one she had met on the 4th.

She responds that when she read the notices, offered by Robert’s mother, she was taken aback by one sentence. That sentence read that the child had gone missing at 07H00 on the 4th of May. This information was supposedly proffered as a result of a telephone call she received. As a result, she set up the information kiosk. The deponent found this strange, given what had occurred between her and this woman on the 4th of May.

She affirms that she became aware of the name of the older woman from newspapers. On the day she initially met her (the 4th of May) this older woman did not identify herself.

She adds that she has many times pondered this situation but always thought it was of no significance. Only today and when she saw what was written did she decide to communicate the fact. She knows with absolute certainty that this older woman was aware of the disappearance given what this older woman had stated to her the morning of May 4th.

Because she is asked, the deponent responds that she bears no grudge against these individuals who she has never seen before. She is certain that this appears an attempt to construct an alibi. There is incongruence between what the older women is stating regarding the 4th and what can be read in the newspapers of today (23 of May, 2007). She felt it her obligation to communicate these facts to the authorities.

And nothing more was said.

Reads, ratifies and signs.

COMMENT: The 'sound of sirens', seem to be some kind of alibi for the Murats. However, SKY News reporter Martin Brunt asked everyone who searched the night of May 3rd and no one heard a siren.

Thoughts of sedation

Thoughts of sedation, always for me, the reason the McCanns could not afford a PM.  But now it has been confirmed JonBenet was molested over a period of time something much more chilling could and would have been revealed. Also a neighbour heard a piercing scream she claimed could have only come from JonBenet, which makes me think of Mrs Fenn and a childs cries that concerned her so much she called her friend. The deleted calls show Kate was in the apartment 15 minutes before Madeleine started crying.
I can no longer feel this is just a simple accident covered up because they sedated their child over of a sleep disorder. Medical records, why were they held back? The heavy lawyers and Goverment involved makes no sense , the McCanns are leading the press around by the nose. The parents still in the driving seat and still calling the shots. The more I read the Ramsey story ,the clearer the picture and I do not like where my thoughts are taking me. .

(10) The ME's examine revealed that there was scaring on JonBenet's uterus that could only have come from ongoing sexual molestation/abuse. Blue FIBERS were found in the VAGINA that did not match anything in the house. There were CELLULOSE Particles in the VAGINA as well, possibly from a paint brush handle. The coroner, Dr. John Meyer, found evidence of sexual assault from the previous night: a small abrasion and small amounts of blood in both her underwear and vagina.  Three medical experts consulting for the police say that the injuries were also consistent with prior sexual abuse. A black light helped reveal that her body had been wiped clean but that a residue of blood was left on her thighs. Dr. Robert Kirschner of the University of Chicago's pathology department went even further, pointing out that her vaginal opening was twice the normal size for six-year-olds. He stated, "The genital injuries indicate penetration,  not only (previously) by a penis, but by another instrument and are evidence of molestation that night as well as previous molestation." "If she had been taken to a hospital emergency room, and doctors had seen the genital evidence, her father would have been arrested."

BBC Whitewashing the death of Madeleine

http://someoneisgettingawaywithmurder.blogspot.com/

http://www.mccannfiles.com/id232.html

Many thanks to Nigel Moore for the video of last nights BBC Farce.

Did we expect any less than complete propaganda from the BBC. This time they even produced the un bleeped version of where Dr.Amaral they claim said'Fuck the McCanns' also implying Amaral was the only officer involved in the case and he made the McCanns suspects all by himself. Profiler Lee Rainbow left out of the equation . Biased reporting on the Madeleine Foundation was expected and implying there are only nineteen people who do not believe the McCanns 'story' of abduction is farcical. It was unfortunate that a member chose to hind behind a concrete block which gave the 'reporter' and I use the term lightly ,a chance to take the piss. Young girls chosen to be interviewed and chew bubblegum for a living, have no knowledge of the police files or even how to use a computer by the looks of them, a mouse is to be fed cheese...no interest in Madeleine or what became of her .. Debbie Butler, was rather spiteful I thought and knowing this was important to the cause could maybe have not thrown Tony Bennet to the wolves at this juncture but have swallowed her pride all for the sake of Madeleine. But she is a woman .I am not going to say scorned but sadly this is the impression she gave.

Until the Gaspar statement becomes public knowledge, little housewives like we saw in this farce from the BBC shall remain ignorant. Now ask a housewife to read Katerina Gaspars thoughts, and then ask what she feels about the McCanns and their buddies...it will be OMG, OMG I did not know this OMG...and that is the reaction you would have received on BBC TV..this of course would have been removed before going to air.

Just out of interest you may like to know most of my readers are from Singapore, Mexico, Russia,Germany and South Korea.

Cheer up Tony, I have left a link on the JonBenet case and they had a body but with political intervention the case was never solved....however Patsy, the mom is dead and the case has now been re-opened, all eyes are on JonBenets brother Burke and what he knows. Burke is being treated with kid gloves, he was there that night and he maybe knows something he was afraid to say at the time, he has been given a number if he ever wants to talk.

The BBC are fools and because of their witch-hunt tactics could not mention Operation Oreor report on the  court hearing.

I wonder if Tony Bennett could have a chat with Louise Shorter, maybe she can find a way to get some reporting of the Police files into the press , it is a long shot but worth a try. Louise claims to believe in Justice, lets see if she will put her money where her mouth is. I understand the McCanns in the eyes of the law are innocent because they have not been charged. The Ramseys, also, but with a lot of political pressure...who the hell sits and writes a five page ramson note in the home ...many , many questions but political meddling shuts many mouths and money talks, it also buys silence.

Letter of resignation, Americas Goncalo Amaral....

TRANSCRIPT BBC

Please note: I have only just finished this transcript and have not had time to go over it for grammatical/spelling errors yet, I'll be doing that in the morning.

Opening words: Hello, tonight Inside Out is at Rothley in Leicestershire to ask, who are the Madeleine Foundation?

Voice over: The three year old’s parents say, they just add to their anquish.

Kate: There’s a certain group out there who...this is their job really...is to pick on a vulnerable family and I’m sure after us they’ll move onto another family

INSIDE OUT
East Midlands

Voice over: They’ve been described as a club for Sicko’s to distribute vile leaflets. Their members insist they’re only trying to discover what happened to Madeleine McCann, but the parents of the missing youngster say the so-called Madeleine Foundation is hindering the search for their daughter and adding to their anguish. Simon Hare has been investigating.

Simon Hare: Well, it’s a Saturday afternoon and most people are busy enjoying their weekend, but somewhere here in Nottingham a group of people have got together to discuss the Madeleine McCann case.
(cuts into Simon answering mobile phone...Hello, Simon...)

Simon Hare (voice over) : Secrecy surrounds what’s been billed as the annual conference of the self appointed Madeleine Foundation. They said I can attend, but I have to wait for news of the location. I’m told to make my way to a hotel with conference facilities, but this proves to be just the meeting place. I’m then taken to the real venue .... a room in this village hall in Nuttall.

A member takes some photos, including one of me. Chairman Grenville Green from Nottingham is also happy to be pictured and the organisations’ secretary and co-founder, Tony Bennett, is keen to promote his new book made up of selected extracts from the case files.

There were 19 people at the meeting and I was told that they’d come from all over the country and that one couple had even come from Northern France. Er, they didn’t want camera’s to come in, but they did allow me to sit there and take notes, they discussed many aspects of the McCann case and they also sold me a copy of their new book (“The Madeleine McCann Case Files – Volume 1”)

But at the moment I still don’t feel I’m any nearer to understanding exactly what the Madeleine Foundation is about.

Cuts into an old interview: Well among those reporters was Simon Hare for East Midlands Today, he’s with us now from Portugal...(fades out)

Simon Hare: But I do know something about the Madeleine McCann case. I was part of the East Midlands Today team that covered the events in Portugal. I interviewed the McCanns in Praia da Luz.

Cuts into old footage of Kate McCann: It really does give you great strength really to see everybody in the village, you know, giving us their support and love and everything

Simon Hare: 3 months later I was in Portamao when they were made official suspects

Cuts into footage of Simon Hare at Portamao: The crowd of onlookers, hundreds of people turned out, many booed Kate McCann as she arrived here. (fades out)

Simon Hare: A development largely thanks to this man (shows footage of Goncalo Amaral arriving at the courts) the Portuguese detective, Goncalo Amaral. But he was taken off the case and in 2008, the McCanns had their suspect status removed.

Cuts into film footage of Kate McCann: We welcome the news today although it’s no cause for celebration ...(fades out)

Simon Hare: And won libel damages from some of the more lurid press coverage they’d received.
A year later, front page news of a different kind, thanks to the Madeleine Foundation.

Cuts into footage: people living in Madeleine McCanns home village say that they are sickened that they’re now being targeted by a campaign to reopen a case against her parents.

Male: A group claiming to want justice for Madeleine says it believes she wasn’t abducted. It’s been sending hundreds of leaflets around the area calling for support.

Simon Hare: It delivered a 150 leaflets to the homes in the McCanns own neighbourhood, repeating the now discredited Amaral theory that Madeleine had died in her parents holiday apartment and they’d covered it up.
Cuts into a female journalist holding a leaflet: And the people here in Rothley who spoke to us today say they’re horrified.

Man in street: It’s absolutely repugnant I think personally.

Woman in street: I just think it’s sad and sick that people have got nothing else better to do with their time.
(Note, the documentary failed to interview those from Rothley who thought the leaflet was informative and joined the Madeleine Foundation after searching out more details.)

Simon Hare: I would meet all of the four people who delivered the leaflets that day. Among them, Debbie Butler the Foundations former Chairman and co-founder who appeared on the BBC to justify their actions.
Cut into footage of Debbie Butler: It’s a Nationwide campaign, we need to put the leaflet into as many doors as possible ...(fades out)

Simon Hare: She’s since fallen out with Tony Bennett and is no longer a member of the Foundation, but she agreed to meet me near her home in Kent.

Debbie Butler: Mr Bennett decided that we would go to that area. I’d never been there, he’d been there before, I found out that he had been there before, erm, he knew where we were going, I drove, we had Grenville Green with us and Helene Davies, his wife. We visited the farm that Kate had taken the children to and had some lunch there. Mr Bennett leafleted there alone and instructed me to go and leaflet in the immediate area where the McCanns live, erm, which I did with Helene and then he told me I must leaflet their road, which I did...I was doing it with Helene but Helene...Helene’s legs just went to jelly and she wouldn’t do it, so I did. I didn’t leaflet their own home at all.

Simon Hare: Tony Bennett denies he told Debbie Butler what to do that day but both were subsequently pursued by the McCanns lawyers and in the November last year, Mr Bennett assured the High Court he wouldn’t distribute any more of the leaflets or he could lose £50,000 and even go to prison for contempt of court.

Cuts into BBC footage of Tony Bennett setting up placards “What really happened to Madeleine McCann” and handing out leaflets to members of the public as they passed.

Interesting the background song to this clip “I don’t care, I don’t care, I don’t care what the people may say about me...”

Simon Hare: But by this summer Tony Bennett was distributing a new leaflet. He’s come to Bristol to what’s billed as the Goncalo Amaral Awareness Day. He’s accompanied by another Madeleine Foundation member who’s a little camera shy.

Cuts into film footage of the member hiding behind a post. Simon joking tells her he’s going around this side of the pillar

Tony Bennett: People think we are representing the McCanns in some way....

Simon Hare: Doesn’t that worry you?

Tony Bennett: Erm, not really no because it’s a chance to explain to people erm what we’re about and that there is a big mystery at the heart of this.

Cuts into film clip of woman on the street: I wouldn’t dare say what I thought – Id’ be sued! (laughs)

Cuts into film clip an elderly couple

Tony Bennett: People will no doubt be reading that leaflet as they pass around the town. Not one person’s come back to me to complain at all and say this is outrageous

Simon Hare: But in the afternoon there are a number of hostile reactions

Cuts into film footage of a group of children (you’ll have to watch the video to get the gist of what the children are saying)

Cuts into film footage of a young male adult: I think it’s a bit disrespectful

Cuts into film footage of a woman on the street: I have a two year old daughter you know, if I’d, If I’d lost my daughter like that woman has I wouldn’t want to think someone was out saying that in the street.

Simon Hare: A few days later after hundreds of copies have been handed out, he (Tony Bennett) agrees to the McCanns lawyers’ demands not to distribute this latest leaflet.

They (the McCanns) didn’t want to talk to us about Tony Bennett’s campaign, but on the third anniversary of Madeleine’s disappearance, Kate and Gerry McCann seemed to allude to the Foundation.

GMTV presenter: You know to this day there are people convinced you had something to do with it, how on earth do you deal with that?

Kate: Well, erm...well I think it’s changed erm, certainly we don’t get the same level of criticism that we did and even then to be fair it was the minority really, I think most people...even if, you know, they don’t agree with...with..., you know, what we did, then they wouldn’t feel it right or fair to add to our suffering.

Gerry begins to talk: I think...

Kate cuts in: But having said that I think it’s just a small minority now and you know there’s a certain group there how, this is their job really, is to pick on a vulnerable family and I’m sure after us they’ll move onto another family.

Cuts into BBC footage of Tony Bennett.

Simon Hare: I think she meant you

Tony Bennett: Er, I didn’t hear that. I don’t know whether she meant us or not but erm we are focused on this particular case, I...my focused on the truth so are the members and supporters of the Madeleine Foundation exactly the same. I haven’t got any history of persuing any individuals

Simon Hare: Tony Bennett previously tried and failed to bring a private prosecution against the McCanns for child neglect.

In 2006 he attempted to mount a prosecution of Michael Barrymore in relation to the night Stuart Lubbock died at the TV entertainers’ home. Another high profile case at the centre of a media frenzy. Tony Bennett first came into prominence by taking direct action over the metrification of signs.

Tony Bennett: A lot of people don’t want to see metres and kilometres on our roadsigns

Simon Hare: A course which won a lot of support. He then began removing road signs to campaign for the introduction of old county boundaries

Tony Bennett: I think the majority of the public would like to see these signs ‘Welcome to Lancashire’ on the correct Lancashire boarder.

Simon Hare: Unlike some of his Madeleine Foundation colleagues, he appears to quite like the camera’s notoriety. Last year he could be clearly seen sat behind Gerry McCann as he gave evidence to a Parliamentary subcommittee on the Press and Privacy. Tony Bennett later posted on the internet:
“It was to send out a quiet message. We are looking over his shoulder, checking out what he and his team are saying. Watching.”

Tony Bennett: If it is certain she was abducted then we are (can’t work out what this word is) to their anguish

Simon Hare: And does, does that not bother you? I mean you’re a father, a grandfather.

Tony Bennett: Erm, I’m persuaded that there are still questions to be answered and, and er, as I say I’ve got to be careful what I say, but then I do question their version of events and whether in fact Madeleine was abducted as do many other people.

Simon Hare: but you don’t know what happened; I don’t know what happened...

Tony Bennett: No I don’t...

Simon Hare: And only those responsible truly know

Tony Bennett: I agree. I agree. We don’t know what happened so why can’t we say erm you know, why can’t we ... I mean after all if I’m making bad points, if we’re making points on our website er they can be challenged and refuted easily can’t they.

Simon Hare: The internet is awash with forums and message boards about Madeleine. Some of these sites have seen threats of violence made towards the McCanns and their family home here at Rothley. Inside Out understands that the police have become involved in the past. People who post on these forums describe themselves as ‘Pro’ and ‘Anti’ McCann. Those connected with the Madeleine Foundation have also been subject to threats.

Debbie Butler: Half past twelve one night my phone rang and er I was told I’d be stabbed in front of my son straight through my heart. I phoned the police...erm...I’ve had other threats

Cuts into footage of Tony Bennett with a Madeleine Foundation member walking through the streets.

Simon Hare: The Madeleine Foundation has come to London. They’re delivering more letters to both the Portuguese and British Governments.

Tony Bennett and three members stand outside 10 Downing Street for photos.

Tony Bennett: So what happens? We knock on the door and someone comes and receives it? Okay.

Simon Hare: The latest leaflet that they’d agreed to stop distributing has made a comeback.

Tony Bennett: Well we’ve had a rethink on that and we see no reason why we shouldn’t distribute it. We weren’t threatened with any libel action or anything like that. We erm, we took a decision three months ago not to distribute it but we’ve reconsidered and see no reason why shouldn’t distribute it, especially on Goncalo Amaral’s birthday.

Simon Hare: But in July the McCanns lawyers, Carter Ruck, had threatened to take Tony Bennett back to the High Court. They’re letter felt that the former solicitor had failed to grasp how libel laws work. And it said that they’d also pursue any other members of the Foundation who delivered the leaflets.

The two remaining Rothley leafleters didn’t go to London. Grenville Green and his wife Helene Davies-Green have stepped down from the Foundation Committee after she was described by the Sun as a ‘Sicko’ who distributes vile leaflets.

Cuts into BBC filming of Helene in the kitchen preparing wild mushrooms.

Simon Hare: She was back in the public eye when she stood as a UKIP candidate in the general election.

Helene Davies-Green: Apparently throwing out the odd insult isn’t breaking their code of conduct.
Cuts into film footage of Grenville Green in Portugal

Simon Hare: It’s an example of free speech that her husband doesn’t like. At the beginning of the year, Grenville Green went to Portugal to attend a court hearing about Goncalo Amaral’s controversial book (The Truth in the Lie)

Grenville Green talking to Sky cameras: Why am I here? It’s freedom of speech isn’t it. If someone has a difference of opinion to someone else er you shouldn’t have lots of money to close you down and shut you up and keep you quiet if you’ve got a difference of opinion, this is why we’re here. It’s freedom of speech; freedom of expression.

Film footage of Journalist asks Goncalo a question as he leaves the Portuguese courts: Is your book hurting the McCanns sir?

Goncalo speaks in Portuguese (presumably "pardon?")

Journalist repeats his question: Is your book hurting the McCanns?

Goncalo Amaral then says the words which have become a controversial subject of whether he swore or said something in his native tongue. Sky News correspondent, Martin Brunt, clears this mystery on his blog 'Life of Crime': “Fala com McCanns” which means “Ask the McCanns”.

Grenville Green: This man is a folk hero, a sort of modern day Robin Hood if you will. It’s like a David and Goliath fight. If something’s right, you know it’s right. If something’s wrong, you know it’s wrong.

Cuts into BBC filming of Tony Bennet: There are always going to be those who entirely believe the McCanns account and who regard me as evil and perverted for what I’m doing. On the other hand there are those who have got legitimate questions and fully support what we’re doing.

Cuts into film footage of McCanns posing for the cameras

Simon Hare: Earlier this month, the McCanns launched an online petition calling for an investigation into their daughter’s disappearance to be independently reviewed (Note: The McCanns have NOT requested an investigation into the disappearance of Madeleine; they merely want a review of the case.)

Cuts into video footage of Gerry and Kate McCann.

Gerry Mccann: there’s absolutely no evidence that Madeleine has been seriously harmed so without her we’ve got to believe we can still find her. Erm, it’s difficult, we know that and that’s why we’re asking for help, we need assistance and the authorities need to do more.

Cuts into film footage of Simon Hare: Last week the McCanns revealed that they are now writing their own book. In a statement on their website Kate McCann said “My reason for writing is simple, to give an account of the truth.” Just like that GMTV interview, I can’t help but feel that that was partly aimed at the Madeleine Foundation.

Smarts on set of TV movie

http://www.youtube.com/watch?v=6FrLgvsv7Cw

CBS to wrap up shooting Oct. 2; film to air this fall

Published: Monday, Sept. 22, 2003 12:00 a.m. MDT
Page:
HALIFAX, Nova Scotia — On a quiet street just outside the downtown area here, a man is making a plea for his daughter to be returned safely after she was kidnapped less than 24 hours earlier.
"Please bring her home . . . please!" the man exclaims with tears in his eyes.
As the man walks away from scores of reporters and photographers there is suddenly another voice in the background, this time a director yelling, "Cut!"
Sitting next to the director and watching with his head resting in his hand is the Utahn whom the actor that just finished the scene was portraying: Ed Smart.

Ed and Lois Smart arrived Sunday on the set of the made-for-TV movie "The Elizabeth Smart Story." The movie has been shooting for about three weeks and is scheduled to wrap up Oct. 2. CBS will air the movie this fall. An exact date is expected to be announced this week.

Elizabeth Smart stayed in Utah and did not travel to Nova Scotia with her parents.
Sunday afternoon, crews filmed the emotional first press conference Ed Smart held after his daughter was abducted in June 2002.

"It's almost like I couldn't watch it. It did seem very real," said Smart after watching the scene. "The red eyes and tears looked good."

That day was the start of an emotional nine-month roller coaster for the entire Smart family. Both Ed and Lois admit it's been tough having to relive it through numerous interviews as the movie script and a book that is scheduled to come out next month were written.

In fact, both the Smarts said they weren't interested in making a movie or writing a book after Elizabeth was found. They had hoped her return to them would be the end of their time in the media spotlight.
"It wasn't that way, and it hasn't been that way since," Lois Smart said.

Both the movie and the book are being told from the point of view of Ed and Lois. Although there has been some criticism of the Smarts for signing a book and movie deal, both say they didn't want to risk someone else telling their story and getting it wrong or putting out a sensationalized version.

"If we didn't do it, then someone else would do it and who better to tell the story than those who have lived it?" Lois Smart asked rhetorically.

Although the movie is being told from her parents' point of view, there were a few points that Elizabeth wanted to add while the script was being written.

For example, Lois Smart said Elizabeth has a response for those who wondered why she didn't try to escape from her abductor.

Eight months was too soon...

Madeleine Beth has only every been for the McCanns and their money making machine a 'cash cow'.
However, for the spineless British journalists a' movie deal' eight months after Madeleine vanished was too much for even them to stomach. The McCanns backed off , they thought it would be OK because the Smarts did it...but there was one big difference Elizabeth was alive, the movie had a happy ending.I would imagine four years is now termed 'respectful' and the McCanns no longer care about a public backlash, . money (the wide agenda) their only interest and lots of it. There is only one way to stop them in their tracks and that is to for the Gaspar statement to become public knowledge, but how?

What CAN Kate and Gerry be thinking?

When I heard that the McCanns are in talks to make a movie of Madeleine's story I instinctively wanted to adopt the brace position - the one you get into on a plane when it's about to hit the ground.

For if such a project goes ahead while Maddie's fate is still unclear it can only be a disaster movie - a disaster for the reputation of the McCanns, and a disaster for those of us who have defended them and prayed for their lost child.

Critics who have never forgiven Gerry and Kate for leaving their kids alone in their holiday apartment will be confirmed in their view that the couple have truly terrible judgment. They will be accused of bad taste; of lacking respect for Madeleine's memory. Kate will be charged with wanting to swan down the red carpet, even though in this case it is sorrow, not vanity, that has reduced her to a Hollywood Size Zero.
Scroll down for more ...
madeleine mccann kate gerry on the beach How much sympathy will this movie idea erode for the McCanns?
Far worse will be the boost given to the ghouls who have lapped up every blood-stained lie put out by the Portuguese police. These are the people who creepily seem to relish the torment of the Leicestershire doctors and accuse them of being everything from child-murderers to fame-obsessed money-grubbers.
Eight months after Madeleine disappeared, there is still not a shred of evidence linking her parents to her death. Two in-depth media investigations, one by the BBC, turned up nothing fresh except Kate and Gerry's anguish.

In fact, testimony over the past fortnight from witnesses who saw suspicious men hanging around the McCann apartment in Praia da Luz has given new weight to the theory that the poor family was stalked. Their four-year-old daughter was the victim of a cold, calculated abduction.

It's what Kate and Gerry have always claimed. It's what any sane person still believes. But a Madeleine movie, however faithful to their version of events, will simply play into the hands of the gossip-mongers.
There is a precedent. In 1980, Lindy Chamberlain claimed her nine-weekold baby had been stolen by a dingo at Ayers Rock. Mrs Chamberlain, who, just like Kate McCann, was accused of lacking emotion, was found guilty of murder. The conviction was overturned in 1988, the same year that A Cry In The Dark, a great film about the case starring Meryl Streep as Lindy, was released.

In other words, the movie did not come out until the case was legally over and emotionally allowed to cool down. Whereas we are still in the thick of the Madeleine case, with feelings running high.

The McCann camp says they would get involved only with "something done sensitively and considerately". The only sensitive thing to do would be not to do it at all. Sources say that millions from a proposed movie deal would help fund the search for Madeleine as the £1.2 million raised from public donations may soon run out.

The problem is the Madeleine Fund is committed to spending £50,000 a month on a Spanish private detective agency. Metodo 3 is given to bullish boasting, which I fear owes more to testosterone than tests. It drip-feeds supposed sightings of Madeleine to the media to justify its huge fees. Yet, so far, they have failed to turn up a single concrete lead.

I can understand how Kate and Gerry must cling to the agency's promises of success, no matter how slender the chance they can bring their daughter back. But if paying the fees means they have to make a movie of Maddie's story to raise more money, then the price is too high.

The danger is they will sacrifice their greatest asset of all, which is public sympathy. That's one more loss the McCanns simply cannot afford.

The accomplices

http://shadplay.blogspot.com/2010/11/deleted-call-records.html

http://shadplay.blogspot.com/2010/11/where-do-you-hide-tree-answer-in-woods.html

Many times after reading 'The deleted calls' by Paulo Reis, I believe his hard work explaining in 'laymans terms' for which I am eternally grateful , comes closest to revealing the timeline of when Madeleine died and it was long before the evening May, 3rd. The maid/cleaner when entering the McCanns apartment the morning of May 2nd noticed one cot in the parents room and one cot in the room Madeleine used. An observation making perfect sense if the McCanns were interrupted in the middle of preparing the scene of an 'abduction' (May 3rd both cots were together). The cleaner also said 'the children were not there'  why would she say this ?  perhaps other times the children had been present, because of their absence  she assumed they were in the creche, she also noticed the crumpled bed, this would be the bed Kate later claimed she slept in after having an argument with her husband, then where had Madeleine slept? the other bed she noticed, unused.

The crying incident ' Why did'nt you come when me and Sean were crying'  thrown in 'as proof '  Madeleine was still alive , words the McCanns could use at a much later date to their full advantage to pour more scorn on their neglect. The time chosen,  could not have been more 'ideal' taking the heat away from the Tapas group who were in the middle of their rogatory interviews and  the McCanns themselves, out of the country 'do gooders forAmber Alert'.  Shocking truth was revealed , not so much the leaking of the statements (although any excuse to bash the PJ) but the fact the parents 'still' left the children after Madeleine had asked her parents such a heartbreaking question. Madeleine, if I read deeply into the 'deleted calls'could not have said those words for the simple reason, she was already dead...it was only her parents words keeping her alive until the eve of May 3rd.

Russell O'Brien , Gerry's main accomplice along with his good friend Matt seemed to have played the major roles in removing Madeleine's remains from the apartment, if this scenario is to be believed ,that is. Russell said Matt was ill Sunday night and stayed in his apartment and yet Russell says in his statement he went to check on Matts children with Matts keys Sunday evening? oooops.... Russell O'Brian, a terrible liar , an even worse memory for his lies.

Russell also states he saw Madeleine twice the morning of May 3rd, of this he is very sure and then his life takes on a haze and he cannot remember if he saw her later that day.

Wednesday evening May 2nd, the group seemed to want to 'make their mark', drink more, stay longer , move away from the table and sit at the bar...why?  to be noticed and to be remembered. Rachael absent, due to sickness? or caring for a group of children who were never left on their own in the evenings?

The afternoon boat trip May 3rd with Russell and Matt, the perfect way to dispose of Madeleines remains.

I went out with Matt sailing, I Jane was looking after Evie.  Whilst I was out sailing with Matt he fell in the water, I had to sail back to save him this made the day quite memorable

The evening of May 3rd,  to create a simulated abduction using the child closest to the age of Madeleine. Tanners sick child ,would have been a   sedated child?.... What they did not count on was Gerry bumping into Jez Wilkins.

--------------------------------------------------------------------------------

Kate McCann May 4th statement 'the abductor was wearing jeans and had long hair'but best to ask Jane'.
Gerry McCann sat in with his wife when she was interviewed ,he could have corrected her about Jane's description ,surely this would have been crucial to get this right? the man Jane 'saw' was wearing beige trousers. Jane has changed her mind many times but never about the clothing. Gerry chose not to interrupt and correct his wife.  Deliberate? I believe so.

Russell O'Brien in his statement said he was wearing jeans (brown) the night, May 3rd. When one thinks of jeans we always think 'blue'. Jane, so quick to explain without being asked she did not take jeans on holiday with her.

Not a lot of trust among the group if Kate was trying at such an early stage to set-up her good friends Tanner and O'Brien  if everything went pear shaped.

Kate May 4th said to Social worker Yvonne Warren , a couple took Madeleine.

http://shadplay.blogspot.com/2010/10/russell-obrien-statement-july-7th-2007.html

I have previously made my statement to the Portuguese Police in relation to my holiday visit to Portugal in April-May 2007. I stayed in the resort of Praia Da Luz and was there at the time of the disappearance of Madeleine Beth MC CANN. I had travelled to Portugal with my wife Jane TANNER, and our two daughters Ella and Evie, also travelling with us was our friends Matthew OLDFIELD, Rachael MAMPILLY and their daughter Grace. We were due to meet our mutual friends over in Portugal David and Fiona PAYNE, their two daughters Lilly and Scarlett along with Fiona’s mother Dianne WEBSTER, and Kate and Gerry MC CANN and their three children Madeleine, Sean and Amelie.  We arrived in Portugal on Saturday 28th April 2007.

On the 8th April 2008 officers from Leicestershire Constabulary interviewed me in order to clarify certain points and in order for me to provide further information where possible. The interviews were visually recorded, however I understand that due to technical difficulties the equipment failed to record. I have been informed that these questions arise from an official request from the Portuguese authorities. I am aware that my statement will be subject to the Portuguese Criminal Code in addition to English Law.

I have been informed that this statement has been made from the monitoring notes which were taken at the time of the interviews being conducted.

I have been given the opportunity to refresh my memory from the statement made by Jane TANNER (my wife) and I have been allowed to see these documents, this was done in the presence of DC 1578 GIERC. I wish to add that Jane’s statement covered our routine from the 28th April 2007-2nd May 2007 quite comprehensively and my original Portuguese statement referred to Jane’s statement, this was therefore a good point of reference for me.

The following statements are answers given in response to the questions asked of me during the interviews, in the order that the questions were asked. (page 1)

We have been away before as couples and have had various conversations about going away as families, the planning took place in January 2007, this was around the time that Jane and I were moving with the girls to Exeter- 3rd January 2007.

It was Fiona and David PAYNE’S idea to go away and Jane and I were more than happy for them to do the organising as we were busy with moving house. We had all been away on Mark Warner holiday’s before, and they seemed to be a good destination. There were emails between us as a group, mainly exchanged with Matt and Dave, things weren’t so straight forward as we were all living in different parts of the country which made planning things very difficult. I am aware that David had made various requests to the Mark Warner Company and one of which was that all the apartments were to be in the same block, and preferably all to be near by to each other.

I am aware that Matt had replied to an email sent by Dave, and by mistake had included Mark Warner on the same reply I recall that it said something along the lines of ‘Go Dave Go’. Dave is quite certain about what he expects from things, and is quite aware of his consumer rights and entitlements although it seemed to be quite trivial to me at the time. We were aware from the various emails that the resort was quite spread out, and Dave strived to keep us all together.  I feel that this may have been construed by Mark Warner staff as having been annoying and the staff member receiving it may have been annoyed by it, I feel that this could be looked upon badly.

We flew out from Gatwick airport having stayed the night with Matt and Rachael at their home which was near to the airport. The others flew out later the same day from East Midlands Airport.

This was the first holiday that we had been on with the MC CANN family we had been away previously with the others in the group. We had been due to go away as couples to Majorca in 2005 but Jane had found out that she was pregnant days after we had booked the holiday, as far as I am aware our places had been given to another couple I believe by the name of Tara and Stuart GOLD.

I’d describe our relationship with the couples as very good, I had met David PAYNE at Medical School in 1989 and we had stayed in Halls and Student Houses together, I met Fiona in 1993/1994 and was best-man at their wedding in 2003, we all went out to Tuscany in Italy for their Wedding.  I recall that Matt and Rachael were there as were Gerry and Kate.  I met Matt in my first year as a Doctor this was in around 1994, again I was close friends with him we lived in the same house, and I was best-man at their wedding in 1999.  I have remained friends with Matt he moves around a lot and has worked in several places and countries.

I would say that our relationship with Kate and Gerry MC CANN is not as close as with the other two couples, I first met Gerry when he was speaking at a conference in Atlanta in 1999, and I recall that we both had interest in the same aspects of cardiology.  I recall that we exchanged emails with each other to discuss various aspects of our research.  Gerry moved to the Glenfield hospital and worked in the same department as I did but I was based at the Leicester Royal Infirmary, at that time Gerry was my equivalent at Glenfield and a voice at the end of the phone- I’d say this was in 2001-2002.

I’d say that we have known Kate and Gerry on a more personal level since 2002-2003 when both Kate and Jane were pregnant with Madeleine/Ella.  At the beginning of their pregnancies they had been given a similar due date, although Madeleine was born about a month before (page 2) Ella.  Our friendship increased through Fiona and Dave, we would often see Kate and Gerry at their house on occasions.

I recall that on one occasion Kate and Gerry visited us with Madeleine, I think that the girls must have been around 9months old as they were crawling.  Other than that I don’t recall them visiting us again, I know that we have been to their house for Madeleine’s 1st and 2nd birthdays but I would say that we hadn’t spent any considerable time at the MC CANN’S home.

In relation to Kate HEALY/MC CANN I have only really met her since Madeleine was born, or through our meeting with Dave and Fiona.

Dianne WEBSTER is Fiona’s mother we obviously met her through Fiona and Dave PAYNE, we have been friends with them for some time meeting them at Fiona and Dave’s house.  We have been for trips out on their boat I’d say we know Dianne quite well.

As far as I am aware there were no others due to go to Portugal, I think that Dave and Fiona had thought of asking others, but Jane and I thought that nine adults were enough.  I recall that Dave and Fiona had mentioned another couple by the name of Dave and Fiona BURLING who live somewhere in Maidenhead but I am not entirely sure whether or not they were actually asked or invited.  I am aware that Dianne was a late edition, but I am not sure when she was booked onto the holiday.

In relation to there being any group hierarchy I’d say that that wasn’t at all the case, Dave, Matt and I have all been close friends since Medical school and see each other as equals, I don’t know Gerry quite as well but there is no problem with him fitting into the group.  I am aware that Dave and Gerry know each other very well.

The flight out to Portugal on the Saturday was early it was around 08:00am we all sat together on the flight and I recall that is where I first saw Jez WILKINS, he was sat near to Matt on the aisle.  I recall that a lot of people were speaking to one and another as people do on the plane, we landed around 10:00am and waited for the baggage, on our arrival we were met by Mark Warner staff.

We were taken out of the airport and out onto the buses waiting nearby, we sat in the middle of the coach on the right hand side.  I recall that Charlotte PENNINGTON who was a nanny at Mark Warner was also sat on the bus- I believe that she looked after Fiona and Dave’s kids.  It was reported in the press that she had seen Kate and Gerry at the airport but I don’t see how that would have been possible as I don’t believe they had arrived by then, I believe that their flight arrived an hour or so after ours did.

Whilst we were on the bus we were given welcome packs and from what I recall we had been allocated room numbers and the packs I do not believe that it included the apartment keys (5D) but I cannot be sure.  I recall that there was also a map of the area.

When we arrived we parked near to the apartment reception and we were taken to our room around lunchtime.  I recall sending a text message to Gerry and Dave to say that we had arrived and also a text to a friend from Germany- who had tried to ring me, I had sent a message to tell them I was away on holiday.

I recall we all went to the pool as the kids wanted to swim, it was a windy and cold I’d say it was mid afternoon time, I remember that the PAYNE’S and MC CANN’S arrived at some point whilst we were all at the pool.  We all went to the welcome meeting at the Tapas Bar on Saturday and I think that we may have gone to another one but I cannot be sure. (page 3)

I recall that they spoke about where to eat, the nannies introduced themselves and I recall that there were various people there from the sporting activities recruiting for their events/activities.

We all went to the Millennium restaurant that evening including the children it was a 10minute walk this was around 18:00-18:30hours, it was at this meal that Matt began to feel quite unwell.  We didn’t stay out late so that we could put the children to bed as it had been a long and tiring day, Jane and I didn’t stay up particularly late as we all felt tired too.

The respective apartments were as follows Dave, Fiona and Dianne 5H, empty apartment 5C, Matt and Rachael 5B- which was a smaller apartment and Kate and Gerry were in 5A.  I believe that the apartments were allocated to fit in with the number in each individual group- as I said previously the allocations appeared to be done prior to our arrival and may have been done following Dave’s emails to Mark Warner.

I recall seeing Jez around the Mark Warner complex we didn’t speak much I hadn’t met him prior to being on the plane, I can’t recall him being on the coach from the airport but I think that he must have been on there as he was staying at the same resort.  I don’t know what apartment he was staying in at Mark Warner, but I think it was quite near us.  I’d like to point out that we had had the occasional conversation on polite terms as well as seeing him at tennis.

Sunday 29th April 2007 I had booked into water-sports on the Saturday but I don’t think they operated on Sunday. I can’t recall exactly what I did on what day but I had booked to have windsurfing lessons and to do a bit of sailing.  My recollection now is a little poor due to the lapse in time I got up around 08:00-08:30am we had breakfast at the Millennium restaurant, we went down to the beach, played a bit of tennis- but as I’m not a brilliant player I wasn’t all that bothered about playing tennis.

We were booked into the Tapas bar, we ate there that night initially it was booked as a one off I think by Rachael as far as I am aware the table was booked for 20:30hours.  I am aware that Rachael asked to eat there each night for the remainder of our stay this I believe was booked on the Monday morning as a block booking- the time was agreed by the group.  Matt was unwell and I recall I went to see him, he had been suffering from a stomach upset so I can say that there were only eight adults at the Tapas bar that night.

The good thing about the Tapas bar was that it was quite near to the apartments, and the walk to the Millennium was quite far away, the Tapas bar was also used by the kids club for afternoon tea.

Kate and Gerry weren’t so flexible about meal times as their children were in more of a routine, as were Dave and Fiona, where as Jane and I are slightly more accommodating and our children have been used to staying up late on occasions.  The bookings were made for the following week 20:30hours after the children were settled in bed.

In relation to the childcare routine it was a collective decision made as a group, Dave and Fiona used their two way child monitor to monitor their children.  Kate and Gerry made a physical check on their children.  Matt and Rachael made a physical check on Grace. Jane and I also made a physical check on Evie and Ella.

I’d like to point out that we knew that there was NOT a baby listening service, this had been picked up before our departure as there had been other inaccuracies in the brochure picked up by Dave, I believe that the brochure inaccuracies would be recorded in emails by David PAYNE. (page four)

Jane and I made checks between courses, and would generally alternate the visits, Kate and Gerry did their checks by the clock.  I’m aware that initially we would only check on our own rooms but on occasions we often listened at other apartment doors or windows, and made checks on some visits.

On Sunday I recall I checked Kate and Gerry’s apartment as well as Rachael and Matt’s. I had taken Matt’s keys and I believe that their door was deadlocked the same as ours and that I would have needed to turn the key two times.  We kept our shutters down, and the patio door was closed I am not sure whether theirs was the same.  I recall that Kate and Gerry’s apartment was accessed by the patios door which was left closed and unlocked.  I recall that their front door was accessed from the car-park access was easily gained to the apartment from the poolside.

All the meals were included in the booking as was a limited choice in drinks, if anything else was ordered there may have been a need to have made an additional payment.  I recall that orders may have been put onto a bar bill and paid at the end of the week.

Sunday we left the restaurant early around 22:00hours the service was reasonable and quite quick, times didn’t vary all that much we may have had a drink at the bar before going back to the apartment but I cannot be sure.

Generally of an evening we would drink beer or have a few glasses of wine, generally three to four glasses, I can honestly say that no-one in our group was ever drunk.  I’d say that generally we had five-six bottle of wine between the group of nine, it was a similar amount most nights.

Monday 30th April 2007 I recall I may have done some windsurfing this was just after I’d dropped Ella off at the kids club near the Ocean Club and Evie at crèche near to the Tapas bar.   I may have done some shopping but I really can’t be certain, I recall Jane, Kate and Gerry playing tennis.  We didn’t eat out at lunchtime we generally ate with Rachael and Matt and this was in our apartment or theirs, as well as at David and Fiona’s.  After Madeleine disappeared we all began eating lunch at Dave and Fiona’s apartment.

I think in the afternoon I may have been out with Matt, I had wanted to spend time as a family but Ella wanted to go to the kids club.  Monday to Wednesday I can say that the days were all very similar and it is difficult to distinguish one from each other.  I know that on one of the evenings either Monday or Tuesday I stayed in the flat with Evie as she wasn’t well Jane brought my meals over to me this was mentioned in my first statement.  I feel that this is more likely to have been Monday as I feel that we were all together as a group on Tuesday- nine adults.  I believe that this was when the Trivia quiz had taken place.

I recall going for a sailing lesson on Tuesday and Jane went to play tennis, we collected the kids as usual around lunchtime, Kate and Gerry had lunch in their apartment as they did on most days.  I went out in the afternoon to the beach I was with Matt and as far as I can recall we went out kayaking. The children were in bed as usual 19:30-20:00 they appeared to be well asleep and checked that they were prior to leaving the days were generally uneventful up until Thursday 3rd May 2007.

On Wednesday Rachael was ill, we stayed out later than normal, after our meal we sat around and then moved into the bar area we stayed for around 45minutes to an hour, this was our only ‘late night’ of the holiday, I recall we had a cocktail.  Checks were made as usual we would alternate completing the checks and this was done every half hour or so.  I listened at (page 5) the MC CANN’S apartment and believe that this was around 23:00hours, on all occasions the children were ok. During the week I checked on some occasions and listened at others.

On the 3rd May 2007 I saw Madeleine in the morning a couple of times this was when I dropped Ella off.  I took the kids up to breakfast at the Millennium club and walked to the Ocean Club I was late getting Ella there, the kids were having a great time at the kids club and all appeared to well.

I went to the flat with Evie, whilst she was resting I read a book.  When she woke up we went outside to watch Jane play tennis I saw Madeleine at lunchtime I can’t recall if Jane or I collected Ella it’s all a bit hazy now.

I recall that Jane had been having a tennis lesson also there was Kate and Rachael.  We were watching some children have their lesson this was before lunch.  I recall that one of the guests a guy from Southampton came over his daughter was playing tennis, he wanted to take a picture but expressed to us how uncomfortable he felt in doing so- he said something similar to feeling like a pervert or a dirty old man when taking a picture of his own child, I do not wish to implicate him.  I recall that the child was of a similar age to Madeleine and Ella.

I recall that Madeleine and Ella had had a similar lesson the day before.

We agreed that in this day and age taking a photograph of your own child you shouldn’t be made to feel uncomfortable, it was a horrible coincident.  I would like to stress that I do not think that this man had any involvement in Madeleine’s disappearance.  I feel that it was a haunting coincidence.

Ella went back to the kids club and I went out with Matt sailing, I Jane was looking after Evie.  Whilst I was out sailing with Matt he fell in the water, I had to sail back to save him this made the day quite memorable that and it being the best day weather wise.  When we came back Jane was at the beach with the children, I recall that at some point around 17:00-17:30 Kate was out running she was dressed in her full running kit which was a vest and shorts- one item was grey and the other pale blue but I cannot say which way round.

When Kate ran past on her run she didn’t speak to us, but she did acknowledge us as a group.

We didn’t stick to our usual routine so much that day the children stayed with us and ate their tea at the bar by the beach called the Paridiso.  Everyone was there at the beach except Kate, Gerry and their kids.  I collected Ella from the Ocean Club before she went up to tea at the Tapas Bar, I cannot say whether Madeleine was there or not.

It was a warm day, good afternoon I recall that I went up to the social tennis around 18:00hours with Matt I think David went to the apartment and then up to Gerry’s.  I played tennis for around an hour to an hour and a half, Dan the tennis coach was also present, as were some other male guests and Gerry we played a mixture of singles and doubles.

The kids came up with Jane, Fiona and Rachael from the beach, but not the MC CANN’S children I presume that they were at the apartment.  They stayed for a short while before going back to the apartment to be bathed and put to bed.  I got back to the flat around 20:00hours as we were running late we had to take the rackets back with us.  The children were in bed Jane went down to the restaurant around 20:30-20:40hours I remained in the flat for another ten minutes or so waiting for them to settle down.  I went down to the Tapas bar the adults of 5H were running late as usual, David and Fiona are always late and it is a standing joke in our group.  Around 21:00hours Matt was going over to check on Grace so he said he would chase (page 6) the Payne’s up as we were all waiting to order and we were conscious that the waiting staff wanted us to place our orders.  I believe that he listened at the windows on his way to find the PAYNES having gone to check on Grace.

The evening was the same as evenings before Kate and Gerry were behaving entirely normally.

Following Madeleine’s disappearance and subsequent search we had made a time line together this will show what time Gerry left the table.  I don’t recall at what point but it was around 21:05 Gerry left the table was only away for a little while, Jane also went to check the children and was gone for a minute or so.  The children were ok she didn’t mention anything unusual.  After we had eaten the starters I needed to go to the toilet so Matt and I decided we would go and check on the children.  We walked together I recall that the light was fading I went straight to 5D I could hear Evie was murmuring.  I went into the apartment and Matt went into his.  I went to the toilet to urinate and then started to clean up Evie and change her, Matt came into my apartment and asked if I needed any help.  It was getting darker by this time.  I said to go back and tell Jane that Evie was unwell.

I sat in the lounge and read to Evie Jane came back having eaten her meal.  We stayed together in the apartment for around 5minutes.  I went across to the Tapas restaurant this would have been around 21:45hours, Jane remained with Evie.  The group joked about Jane having been to relieve me they were all in good humour.  Kate left the table there was nothing significant about her leaving but I think it was a similar time to my meal arriving.  I think that this would have been around 22:00hours, I didn’t have a watch or phone to check the time but Rachael did ask for the time and 22:00hours was mentioned.  I know that she didn’t leave straight after me arriving back as the waiters had agreed to cook me a fresh meal.

Kate returned through the reception area standing at the end of the path near the stones, and yelled over towards our table in the Tapas bar I cannot recall exactly what she yelled but it was along the lines of Maddy is missing.  We all got up immediately except Dianne who remained at the table.  I am fairly sure on the time, I have put a great deal of thought who may have been watching us during the week, but all appeared quite normal to us, the people who would have known our routine would have been the waiters.  I can’t recall any other people dining in the restaurant at the time, there would have been people in there but as we ate quite left they would have left during our meal.

We went over to Gerry and Kate’s apartment I didn’t go in to the apartment.  I can recall it would have been a similar layout to ours, although the furniture and décor was different to ours as the apartments are leased.  I didn’t go into the bedroom on this occasion, but I’d imagine that there are wardrobes in there as there are in ours.  When I had been into the apartment on previous occasions it had been dark.

During the interview I drew a seating plan of the Tapas bar and who was sitting where which I have previously marked and produced as my exhibit.

On the evening I was wearing brown jeans/cord style trousers, a pale blue stripe top, and Jane had taken my jumper which was blue.  The nights were quite chilly which is why Jane had my jumper I am quite used to the cold.

Former Jersey senator Stuart Syvret jailed for contempt

Stuart Syvret Stuart Syvret, a former Jersey senator and health minister, represented himself in court

Former Jersey senator Stuart Syvret has been sentenced to 10 weeks in prison for contempt of court.
Mr Syvret, 45, left the island between November and May and failed to make court appearances, the island's magistrates' court heard.

He was also found guilty of two charges of breaking data protection laws.

The court heard he published on his blog a confidential police report into suspicious deaths at the island's General Hospital.

The report contained the name and details of a suspect.

After a thorough police investigation officers found no evidence that any crime had been committed, however.

Mr Syvret published the report on his blog believing there was a cover up and that it was in the public interest, the court heard.

He was fined a total of £4,200 and ordered to pay £10,000 in prosecution costs for the data protection breach.

Magistrate Bridget Shaw offered Mr Syvret the chance to be assessed for community service but he declined.
